Terms of use for apprentices

AzubiWay is a service of pivot recruiting GmbH, Straße der Hoffnung 7, 64832 Babenhausen, Germany, represented by its managing directors David Alexander Neu and Marc Trojan, Darmstadt Local Court HRB 105888. Email: info@pivot-recruiting.de, phone: +49 6106 6671355. These terms apply to the use of the AzubiWay platform and the app by apprentices. You accept them when you create your account.

(1) On AzubiWay you find training places in Germany, can apply and can talk to companies. After an offer, the platform guides you through the visa procedure with tasks, deadlines and reminders.

(2) AzubiWay is free of charge for you. We do not ask you for any money, neither for the placement nor for the support. You pay third-party fees, for example for the visa, translations or a blocked account, directly to the respective body.

(3) We do not give legal advice and no guarantee. The competent authorities and the company decide on the visa, the approval of the employment agency and the training contract, not us.

(1) You need an account. Your details must be complete and correct. Keep them up to date.

(2) Do not pass on your login details and one-time codes to anyone, not even to agents or acquaintances.

1. Your details, certificates and evidence must be true.
2. Uploaded documents must be genuine and fully legible. Forged or altered documents lead to your account being blocked immediately and end the procedure.
3. Your introduction video may only show you.
4. Complete your tasks in the procedure on time.

(1) You talk and write to companies you get to know through AzubiWay only through the platform, until your training contract has been concluded through AzubiWay. Do not pass on your contact details outside the platform and do not ask for the company’s contact details either.

(2) This is how we protect you from dubious offers and make sure that your procedure is fully documented.

(3) If you break this rule, we can block your account.

(1) The content you upload still belongs to you. You allow us to store it, process it technically and show it to the parties to your procedure, insofar as this is necessary for our service. This permission ends when you delete your account.

(2) We may remove content that violates these terms or applicable law.

(1) You can delete your account yourself at any time. You can also cancel using the “Cancel contract” button at azubiway.de/en/cancel-contract.

(2) We can block or delete your account if you have violated these terms, in particular in the case of false details, forged documents or contact outside the platform. We will inform you about this.

Cancel contract

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.

(2) In the case of simple negligence, we are only liable for the breach of an essential contractual obligation and limited to the foreseeable damage typical for the contract.

(3) We are not liable for decisions of authorities and companies, for waiting times or for information provided by other users.

How we process your data is set out in our privacy policy.

If we change these terms, we will inform you in advance in the app and by email. The new version only applies to you once you agree to it. If you do not agree, you can delete your account. We can then end the user relationship with four weeks’ notice. We will continue an ongoing procedure under the old version until it is completed.

Right of withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded, that is, from when you created your account.

To exercise your right of withdrawal, you must inform us (pivot recruiting GmbH, Straße der Hoffnung 7, 64832 Babenhausen, Germany, phone +49 6106 6671355, email info@pivot-recruiting.de) of your decision to withdraw from this contract by an unequivocal statement, for example by letter or email. You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication before the period has expired.

You can also exercise your right of withdrawal online at azubiway.de/en/withdrawal (button “Withdraw from contract”). If you use this online function, we will send you an acknowledgement of receipt by email without undue delay, with the content of your declaration and the date and time it was received.

Effects of withdrawal. If you withdraw from this contract, we must reimburse all payments we have received from you without undue delay and at the latest within fourteen days. As AzubiWay is free of charge for you, you will not receive any payments back from us. With the withdrawal, your use ends and we delete your account, unless a statutory retention obligation applies.

(1) The law of the Federal Republic of Germany applies. The protective provisions of the country in which you have your habitual residence remain unaffected.

(2) These terms are available in German, English and Vietnamese. You can choose the language in the app.

(3) Should any provision be invalid, the validity of the remaining provisions remains unaffected.
